Council of State Opens Door to Private Management of Greek Marinas

marinaThe Greek Council of State has given the green light to private entities to lease and operate marinas across the country, without however having the right to claim ownership of the said properties.

According to the decision, a legal entity under public or private law has the right to manage marina facilities in a manner that is profitable to the Greek state and can perform works and land projects that will improve facilities at these ports or marinas.

Privatization will only proceed when it is to the public interest and complies with legal obligations relating to environmental protection and archaeological regulations.

Administration and management of tourist ports can either be exercised directly by the same public body or awarded by concession to third parties, provided there is control by the state. Marinas must be publicly accessible and the leasing party must maintain the public character of the marina, facilities and surrounding area. Additionally, security and supervision of the marinas remain under the jurisdiction of the port authorities.
