The investigation, IATA stated, must adhere to the provisions of Annex 13 of the Chicago Convention, which requires the publication of an interim report within 30 days of an aviation accident. Flight 8243, an Embraer 190AR en route from Baku to Grozny, reportedly encountered a Russian air-defense missile near Grozny, Russia. Despite sustaining severe damage, the aircraft managed to continue flying before crash-landing near Aktau, Kazakhstan. Tragically, 38 of the 67 passengers and crew on board lost their lives, while 29 others survived with injuries. Authorities are still investigating the precise circumstances of the incident. Azerbaijan Airlines has suspended flights from Baku to Grozny and Makhachkala until the investigation into the crash is completed. Photo source: Azerbaijan Airlines “Our deepest sympathies are with the families and friends of those who perished,” said IATA Director General Willie Walsh. “Out of respect for the 38 lives lost and the survivors, it is crucial to determine why this tragedy occurred and take action to prevent such incidents in the future.” IATA’s appeal follows confirmation from the governments of Russia and Azerbaijan that the crash occurred in Russian airspace near active military operations. “Civil aircraft must never become intentional or accidental targets during military operations,” Walsh highlighted, adding that the potential involvement of military activity in the crash underscores the urgency of a thorough and transparent investigation. Walsh stressed the importance of holding any responsible parties accountable, should the findings confirm such culpability. “The world eagerly awaits the required interim report, as mandated by the Chicago Convention. Should combatants be found responsible, they must face justice,” he added. Amid increasing global conflicts, IATA in October reminded the UN Security Council of state obligations to safeguard civil aviation. These include commitments under Article 48 of the Geneva Conventions, which prohibits targeting civilian objects, and the Chicago Convention, which obliges states to protect civil aircraft and passengers. To further mitigate risks, IATA supports the work of the Safe Skies Consultative Committee, which focuses on reducing conflict zone risks through enhanced information sharing and conflict zone guidance for states and operators.
